Max DuVal is a member of the Litigation group, representing secured creditors and lenders in complex commercial disputes and bankruptcy matters.
He guides clients through Chapter 7 and 11 proceedings, managing litigation, depositions, hearings, oral arguments, and trials with a strategic focus on achieving efficient, results-driven outcomes.
Max handles all aspects of commercial and corporate restructuring litigation, including drafting complaints and adversary proceedings, motions for summary judgment and default judgment, handling all aspects of discovery,, managing proofs of claim, and objections to various relief requested in corporate restructuring and commercial litigation matters. He helps clients navigate corporate restructuring and commercial litigation matters while balancing legal strategy with business objectives.
Before joining the firm, Max gained hands-on experience representing numerous corporations and individual debtors in chapter 7 and chapter 11 bankruptcies, drafting plans of reorganization and liquidation, fee and retention applications, motions for “first-day” relief, approval of post-petition credit, and sale of assets, and other key bankruptcy documents, providing him with a strong foundation in both litigation and transactional aspects of complex bankruptcy cases.
Experience
- Successful conversion of three chapter 11 cases to chapter 7 filed by a franchisee fast food operator in the United States Bankruptcy Court for the Eastern District of California.
- Obtained court approved adequate protection agreements and favorable plan treatment for clients in various chapter 11 cases across the country.
- Successfully coordinated the surrender and return of numerous collateralized vehicles for clients in response to the winding down or liquidation of various chapter 11 and 7 debtors.
- Obtained relief from the automatic stay in several chapter 11 cases for clients to either proceed with state court litigation or sell their collateral pursuant to their applicable contracts.
- Obtained pre-judgment replevin order for client with regard to thirty-nine (39) collateralized vehicles.
- Successfully assisted clients with recovering and liquidating collateralized vehicles and equipment after obtaining appropriate relief in bankruptcy or state court.
