Sergio Molina is a member of the Firm’s Litigation practice group, representing domestic and international clients across various industries through their complex commercial, criminal, and investigative matters.
He guides high-exposure clients throughout all facets of multimillion-dollar disputes from pre-suit investigation through to trial and appeal. Sergio draws on his experience in private practice as a career litigator and judicial extern in Florida’s Eleventh Judicial Circuit and the U.S. District Court for the Southern District of Florida to deliver practical, strategic solutions that minimize his clients’ exposure to risk and align with their business objectives.
In his complex commercial litigation practice, Sergio represents clients in disputes involving contracts, business torts, bankruptcy litigation, intellectual property, real property, asset forfeiture, and information privacy, including matters concerning the enforcement of creditors’ rights for financial institutions and the protection of sensitive client data. In his government investigations and white collar criminal defense practice, Sergio represents companies and individuals in domestic and cross-border matters involving the United States Department of Justice (DOJ), the Securities and Exchange Commission (SEC), and other criminal law enforcement and civil regulatory authorities. He assists clients in trials, internal investigations, and corporate compliance reviews involving claims of mail and wire fraud, public corruption, bribery, extortion, and violations of the Foreign Corrupt Practices Act (FCPA) and the False Claims Act, among other sanctions regimes.
Leveraging his native fluency in Spanish, Sergio services the Firm’s Latin America Group and separately educates legal professionals throughout Mexico on litigation practices. He is also an active advocate for the LGBTQIA+ community, promoting diversity and inclusion initiatives and publishing on the intersection of law, privacy, artificial intelligence, intellectual property, and commerce.
Experience
- Represented a corporate client before a state appellate court in connection with the appeal of a final judgment interpreting a permanent injunction, resulting in reversal of the final judgment.
- Represented individuals in federal district court in connection with their claims for breach of contract and fraudulent transfer, among other claims, against foreign business entities and individuals, resulting in judgment entered in the client’s favor following trial.
- Represented individuals in state court in connection with their mortgage foreclosure claims against a property development company, resulting in judgment entered in the client’s favor following trial.
- Represented a foreign nonprofit clerical association in bankruptcy court in connection with its fraud claims against a debtor seeking discharge, resulting in judgment entered in the client’s favor.
- Represented a trust in state court and bankruptcy court in connection with its claims against the estate of a former trustee and related co‑conspirators for breach of fiduciary duty, violations of Florida’s Trust Code and LLC Act, conversion, civil theft, and fraud, among other claims, resulting in settlement.
- Represented a corporate client and its individual members in federal district court and on appeal in connection with their claims against a foreign government for violations of international law arising from alleged expropriation of property.
- Represented a media company in federal district court in connection with the defense of copyright infringement claims asserted by a photojournalist, resulting in settlement.
- Represented an individual in federal district court in connection with the defense of trademark infringement and cybersquatting claims asserted by a business entity, resulting in settlement.
